Please read these Terms of Service ("Terms") carefully before using the My AI Sales Coach mobile application (the "App") operated by Search Global Pty Ltd ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

My AI Sales Coach is a mobile application that provides:

  • Audio recording of sales conversations
  • On-device transcription of recordings
  • AI-powered sales coaching and analysis using proven methodologies
  • Export and sharing of transcripts and analyses

2. Account Registration

To use certain features of the App, you must create an account using Apple Sign-In or Google Sign-In. You agree to:

  • Provide accurate account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised use

3. Subscriptions and Payments

3.1 Subscription Tiers

The App offers the following subscription options:

  • Free: 3 AI analyses per month, 7-day history retention
  • Pro ($29.99/month or $299/year): 30 AI analyses per month, 90-day history retention
  • Rainmaker ($99.99/month or $999/year): 100 AI analyses per month, unlimited history retention
  • Lifetime Pro (Founding Member) ($399.99 one-time): Non-consumable purchase granting Pro tier permanently

3.2 Billing

  • Subscriptions are billed monthly or annually through your Apple ID account
  • Payment is charged upon confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Lifetime Pro is a one-time purchase and does not renew

3.3 Cancellation

  • You may cancel your subscription at any time through your Apple ID Account Settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods

3.4 Price Changes

We reserve the right to change subscription prices. Price changes will not affect active subscription periods and will be communicated in advance.

4. Acceptable Use

You agree NOT to:

  • Use the App for any unlawful purpose
  • Record conversations without proper consent from all parties where required by law
  • Upload or transmit malicious code or content
  • Attempt to gain unauthorised access to our systems
  • Use the App to harass, abuse, or harm others
  • Reverse engineer or attempt to extract source code from the App
  • Resell, sublicense, or commercially exploit the App
  • Use the App in violation of any applicable laws or regulations

5. Recording Consent

Important: You are solely responsible for ensuring you have proper consent to record conversations in accordance with applicable laws. Recording laws vary by jurisdiction:

  • Some jurisdictions require all-party consent
  • Some jurisdictions require only one-party consent
  • Some jurisdictions prohibit recording certain types of conversations

We strongly recommend you:

  • Inform all parties that a conversation is being recorded
  • Obtain explicit consent before recording
  • Comply with all applicable local, state, and federal laws

We are not responsible for your compliance with recording consent laws.

6. Intellectual Property

6.1 Our Property

The App, including its design, features, content, and underlying technology, is owned by Search Global Pty Ltd and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal or internal business purposes.

6.2 Your Content

You retain ownership of your recordings, transcripts, and any content you create using the App. By using the App, you grant us a limited license to process your content solely to provide the services.

7. AI-Generated Content

7.1 Nature of AI Analysis

The coaching feedback and analysis provided by the App is generated by artificial intelligence. This content is:

  • Provided for informational and educational purposes only
  • Not a substitute for professional sales training or advice
  • Generated based on general sales methodologies and may not account for specific circumstances

7.2 No Guarantees

We do not guarantee that following AI-generated advice will result in improved sales performance or any specific outcomes.

8. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at https://mysalescoach.app/privacy

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEARCH GLOBAL PTY LTD SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Search Global Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your recordings or content

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account and associated data
  • Provisions that by their nature should survive will survive termination

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by the laws of Victoria, Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Victoria, Australia.

15. Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us. If a dispute cannot be resolved informally, you agree to binding arbitration where permitted by law.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Search Global Pty Ltd regarding the App.

19. Apple-Specific Terms
